Consumer, retail and leisure

The consumer, retail and leisure sectors do business at the cutting edge of change. That's where we practice law and can guide with a clear view.

Why should we use Nicholas Weston?

We assist clients by delivering on time, in full, shortening your timeline to making a decision, and getting on with running the business, whatever the issue. We solve our client’s problem of requiring multi-faceted legal and commercial advice without having to explain the current reality of doing business in retail or leisure. Our strong portfolio of current and past clients have sought us out for advice from business structuring to brand clearances, from food safety to franchising, from e-commerce to employment law, from commercial agreements to consumer product litigation and from data protection to corporate governance and risk management.

We are service focused and act as part of your team. Our relationships with our clients are based on trust, transparency, open communication and doing what we say we are going to do.

How do we do it?

The firm’s Principal, Nick Weston, has worked directly in the retail and leisure industries. After university, he has provided legal and commercial advice to businesses in the leisure and retail sectors for more than 25 years. He has also served as the CEO of a publicly listed technology company and understands business from an operational rather than just an advisory point of view.

Nick is passionate about going the extra mile to help close a deal, sort out an employment issue, negotiate a contract and solve other challenges that are faced by consumer, retail and leisure companies active in Australia and internationally.

He uses direct representations and drafts correspondence for you. After an initial discussion to understand the context and objectives of an issue or contract you need help with, Nick can provide an accurate fee estimate for the work involved then conduct a review with written advice and recommendations within an agreed timeframe. Any follow up steps, such as help with negotiations, are scoped (so far as that is possible when third parties are involved) and we agree next steps. Just call or email to begin. Some of the advice and services we provide include the following:

  • Brand issues (trade marks, copyright, designs, domain names)
  • Promotions regulation and compliance
  • Product packaging and labeling
  • Commercial litigation
  • Commercial and retail leases
  • Consumer product litigation
  • Contracts and commercial agreements
  • Corporate structuring and shareholder issues
  • Data privacy and cybersecurity
  • Distribution, logistics, and supply chain
  • Ecommerce
  • Employment
  • Franchising (franchise agreements, Code compliance, onboarding and exiting franchisees)
  • Insolvency issues and PPSA
  • Licensing
  • M&A
  • Product labelling
  • Health and safety regulation and litigation
  • Social media and online business

What can we do for you?

Like most M&A lawyers, we offer technical competence in M&A. We combine this with decades of experience on-the-tools, gained working inside and acting for mid-market tech companies (listed, unlisted and owner operated), giving us an ability to anticipate menaces to navigation and guide you through the options on the path to closing, as we have for others, many, many times previously.
